Terms of use



1. Introduction

  1. These Terms of Use specifiy how the WebPing service can be used. They also explain the rights and duties of Users, and the duties and responsibilities of the WebPing Service Provider.

  2. Some concepts used in these Terms of Use can be capitalised to mean the following:

    1. Terms of Use (or "Terms" in short) - this document.

    2. User - a natural or a legal person who has registered to the Service and is using it.

    3. Service Provider - ISPRO - Systemy Internetowe, ul. Lindego 1C, 30-148 Kraków.

    4. Website - the WebPing website and all its features.

    5. Package - a set of Monitoring parameters that can be defined by the User to specify, for example, the frequency of text messaging notifications or the number of Services available for Monitoring.

    6. Monitoring - the service provided by the Website, meant to check the availability of the Services added by the User.

    7. Service - webpage address defined by the User in the Panel for Monitoring purposes.

    8. Registration - creating an account on the Website.

    9. Panel - the panel to which the User has access in order to add Services for Monitoring.

2. Technical Requirements

  1. Requirements for the Website to work correctly are as follows:

    1. a PC or a mobile device (a smartphone, a tablet) with access to the Internet

    2. a web browser:

3. How the Service Works

  1. The Website is Monitoring the availability of Internet Services defined by the User.

  2. Monitoring takes place simultaneously from several independent servers.

  3. The Website checks if the address provided by the User when configuring a Service contains a specific string of characters.

  4. If the Webiste cannot find the defined string of characters, the Service is unavailable.

  5. Every instance of a Service being unavailable is logged in the Panel.

  6. At the same time, the Website notifies the User with a text message and/or an email, depending on the Package the User has and on the configuration of the Service.

  7. A notification is also sent once the Service becomes available again.

4. Packages

  1. The User can select one Package. The current parameters of each Package are described in the "Pricing" tab on the WebPing page.

  2. With the purchase of the Package, the user receives a license to use the Website.

  3. The license entitling the User to use the Website is granted for a fee.

  4. The entirety (100%) of the remuneration paid by the User for granting access to the Website is the payment for granting a license authorizing the User to use the Website.

  5. The parameters of a Package include its price, its duration, the number of Services Monitored, the number of available text messaging notifications and the number of additional Users per account.

  6. The User can upgrade their Package by selecting the relevant option in the Panel and paying the difference in price. The difference depends on how long the current Package is still valid for and how much the new Package costs.

  7. The User can downgrade their Package, starting from the next pay period and keeping the parameters of the current Package until it lasts. To downgrade the Package, the User needs to complete a contact form.

5. Obligations of the User

  1. During the Registration, the User is obliged to provide valid company or personal data and contact details.

  2. The User is obliged to keep the provided information up-to-date, so that it always stays correct.

  3. The User is obliged to make timely payments for the selected Package.

  4. The User confirms ownership of the provided phone numbers and email addresses.

  5. The User is obliged to use the Website according to the current law.

  6. The User confirms that they either are the owner of the Monitored Services or have the owner's permission to Monitor the Services. The User agrees that the Service Provider can put the User's logo or other graphic signs on the WebPing page and mention the User as a WebPing customer.

6. Obligations of the Service Provider

  1. The Service Provider is obliged to Monitor Services, according to the parameters of the Package selected by the User, so that top stability and quality are provided.

  2. The Service Provider will inform the User of any Website issues that affect Monitoring of the User's Services.

  3. The Service Provider will not be responsible for errors in Monitoring that are beyond The Service Provider's control, especially errors attributable to the web hosting provider, as well as system and network errors.

  4. The Service Provider is not responsible for delivering text messaging notifications with delays resulting from GSM network instability or crash.

  5. The Service Provider reserves the right to suspend the Website temporarily to perform maintenance work, but for a period not longer than 24h. For this period the User is entitled to a refund of 1/30 of the price of the selected Package.

  6. The Website is supporting the User and informing when the Services are unavailable. However, the Website is not a replacement for the User's IT Department so the Service Provider is not obliged to make the Services available.

7. Complaints

  1. Any complaints related to how the Website works need to be made either through the contact form available on the WebPing page or by sending an email to .

  2. The Service Provider is obliged to consider the complaint within 14 days after receiving it or after collecting all the information necessary to consider it.

  3. Every complaint should contain the description of the issue, the type of Package used, and a contact email address.

  4. The Service Provider replies to the email address provided in the complaint.

8. Personal data and privacy policy

  1. The Service Provider processes personal data entered by the User to deliver the services.

  2. The User can check their personal data, edit it and also have it deleted when resigning from using the Website.

  3. The Service Provider reserves the right to send information related to the User's activities on the Website as well as commercial information to the email address provided by the User during the Registration.

  4. When delivering the services, the Service Provider also processes data that is not treated as personal data defined by the Personal Data Protection Act. The scope and purposes of data processing is explained in the Privacy Policy available on the WebPing page.

9. Final provisions

  1. The up-to-date Terms can be found on the WebPing page.

  2. The Service Provider reserves the right to modify these Terms, having notified the User with an email beforehand.
